Flight Centre awaits price fix penalty ruling

Flight Centre has returned to the Federal Court in Brisbane today for the next stage of the price fixing case brought by the Australian Competition and Consumer Commission (ACCC).

A judgement ruled in favour of the ACCC last month, a decision which is being appealed by Flight Centre.

Both sides returned to court today for a penalty decision. The outcome of the hearing was not known at time of going to press.

Flight Centre was found to have attempted on six occasions to enter into arrangements with Singapore Airlines, Emirates and Malaysian Airlines to ensure Flight Centre was not undercut on the airlines’ websites.

No accusations were made against the airlines.

Flight Centre has lodged an appeal against the ruling, saying that a preliminary analysis of the judge’s findings had revealed “errors of law”.

Flight Centre said the ruling also represents an "inappropriate extension of the law" that may have implications for retailers and agents in other industries.
