BA passengers’ DVT case goes to House of Lords
 
The UK’s House of Lords is being asked to rule on a compensation claim on behalf of British Airways passengers who suffered deep vein thrombosis.

The Lords is the country’s highest court of appeal.

If it rules in favour of the claimants, a class action will be mounted against 18 airlines, including Qantas, British Airways, Virgin Atlantic Airways and Continental Airlines.

The case involves seven BA passengers who either died or claimed their lives were impaired after developing DVT.

They are seeking a ruling on whether the DVT linked to air travel could be considered accidental under the Warsaw Convention, which covers compensation for death and injury during air travel.

In previous appeals, both the UK’s High Court and its Court of Appeal denied airlines were liable for the condition.

An airline spokesman said BA was confident the House of Lords would uphold the previous decision in favour of the carriers.
